● Client - person to whom ‘Anne Zorgt’ provides a service.

General

These general terms and conditions apply to the services provided by ‘Anne Zorgt’ and the client and can only be deviated from in consultation.

‘Anne Zorgt’ hereby grants access to the website www.annezorgt.nl and publishes texts and other matters provided by ‘Anne Zorgt’ and third parties. ‘Anne Zorgt’ reserves the right to change the content or remove parts at any time without having to notify visitors.

 

Limited liability

The information on this website has been compiled with the utmost care. Nevertheless, ‘Anne Zorgt’ accepts no liability for the accuracy and/or completeness of data as displayed on this website. All information on the website is subject to typing and programming errors. No liability is accepted for the consequences of such errors. No agreement for the provision of services is concluded on the basis of such errors. No rights or guarantees can be derived from the information on this website.

 

When ‘Anne Zorgt’ enters into an order for services in any form, this only applies to ‘Anne Zorgt’ as an obligation to make an effort and not an obligation to achieve results. There is therefore no possibility for a ‘no-cure-no pay’. ‘Anne Zorgt’ is never liable for consequential damage. ‘Anne Zorgt’ performs each service to the best of her knowledge, ability, honour and conscience and good craftsmanship.

Confidentiality

‘Anne Zorgt’ follows the rules of confidentiality and privacy as are customary in

healthcare. Parties are obliged to maintain confidentiality of all confidential information that they have obtained from each other in the context of the agreement for services. Information is considered confidential if this has been communicated by the other party. All information that the client shares with ‘Anne Zorgt’ during the introductory meeting will be treated confidentially. This information will never be provided to third parties without the client’s written permission.

 

Indemnification

The client indemnifies ‘Anne Zorgt’ against all claims from others that are related to the services provided by ‘Anne Zorgt’. ‘Anne Zorgt’ is only

liable for damage suffered by the client, when that damage is caused by intent

and/or deliberate reckless behavior. A shortcoming by ‘Anne Zorgt’ cannot be

attributed in the event of powerlessness such as an emergency,

strikes, government measures, power failures, transport problems, etc.

If ‘Anne Zorgt’ cannot keep its appointments due to these

shortcomings, the appointment will be suspended. Appointments between the client and

‘Anne Zorgt’ can be canceled free of charge up to 24 hours before the appointment. Appointments that are canceled too late or forgotten outside or within the term

will be charged in full.

 

Agreements for service orders and rates

When the client uses the services of ‘Anne Zorgt’, the client agrees to the general terms and conditions as stated on this website. Request for service by the client becomes an order as soon as the order for service has been approved by ‘Anne Zorgt’ and the client.

 

‘Anne Zorgt’ uses prices in euros including 21% VAT. Including travel expenses when the service is provided in The Hague or Wassenaar. Outside these areas, a business mileage allowance of €0.23 per kilometer driven will be charged. The hourly rate of ‘Anne Zorgt’ excludes the parking costs that apply to the client. ‘Anne Zorgt’ is free to change the prices on the website.

 

Payments

Payment must be made within 14 days after the invoice date, invoices are sent digitally. If the invoice has not been paid after 14 days after the invoice date, the client/principal is in default.

 

‘Anne Zorgt’ may make her services dependent by demanding immediate payment for the total amount of the services already provided. If payment is not made within the set 14 days, she will not continue her services.

If the client does not pay or the invoice is paid too late and the client is in default, ‘Anne Zorgt’ is entitled to:

a standard compensation of € 40.-.

a compensation for costs incurred such as legal costs or collection costs.

interest over the period that the client does not pay after the payment term has expired.

Termination

‘Anne Zorgt’ may terminate the agreement (approved assignment) for services with the client if the client does not fulfil his or her obligations under the agreement or does not fulfil them in a timely manner, or if ‘Anne Zorgt’ has become aware of circumstances that give her reason to assume that the client is not fulfilling his or her obligations.

‘Anne Zorgt’ may terminate the agreement at any time if no respect is shown and/or if there is (verbal/non-verbal) violence or any form of threat.

NB; In the case of end-of-life care, ‘Anne Zorgt’ will never advise to stop taking medication or replace it with something else. ‘Anne Zorgt’ will not make medical diagnoses or provide medical advice and will always refer the client to the general practitioner, nurse or medical specialist for palliative care.

Reimbursements

Palliative (terminal) care (including attention to meaning and spirituality, help and support for loved ones and informal caregivers) can be reimbursed from the Long-term Care Act (Wlz) or the Health Insurance Act (Zvw). Which one applies to you depends on your situation.

 

End-of-life care can be paid from the PGB (personal budget) provided there is a Wlz (Long-term Care Act) palliative indication. A terminality declaration is required for the personal budget (pgb) to purchase palliative care yourself. You may deduct the services of 'Anne Zorgt' from your income tax under the heading 'Extra Family Help', if you need family help due to illness or disability.

Complaints

Complaints about the services provided must be submitted in writing to ‘Anne Zorgt’ by the client within 14 days. The client

describes the situation, his or her dissatisfaction clearly and in as much detail as possible,

so that ‘Anne Zorgt’ can respond appropriately. ‘Anne Zorgt’ will confirm the complaint within 8

days of receipt, stating the contact person. The complaint will be handled as quickly as possible and treated confidentially. The client must demonstrate that the complaint relates to the services provided by ‘Anne Zorgt’.
